If you’re considering filing for divorce in Minnesota, you’ll want to be aware of the first step in the process and what to expect as you prepare to start this new chapter. In this blog post, we will discuss the steps involved in filing for divorce in Minnesota.

Requirements to File

To file for divorce in Minnesota, you must have been a resident of the state for at least 180 days. If you have not been a resident of the state for this amount of time, you may still file for divorce if your spouse is a resident. Your situation must meet one of these requirements to file for divorce in Minnesota.

Beginning the Process

The first step in filing for divorce in Minnesota is to file a Petition for Dissolution of Marriage with the court. The person who files the petition is known as the petitioner, and their spouse is known as the respondent. The petitioner must file the petition in the county where they or their spouse currently live.

The petitioner must then serve the respondent with the petition and a Summons. The respondent has 30 days to file a response to the petition with the court. If they do not file a response, the petitioner can ask the court to grant them a default divorce.

If both parties agree to the terms of their divorce, they can sign an uncontested divorce agreement and file it with the court. The court will review the agreement to make sure it is fair and equitable and then issue a Final Judgment and Decree of Dissolution of Marriage.

If the parties do not agree on the terms of their divorce, they will need to go through the contested divorce process. This process can be more complex and time-consuming, so it is important to consult with an experienced divorce attorney.
