Early Neutral Evaluation (ENE) is a unique form of mediation designed to provide parties with an early, realistic perspective on their case from a neutral evaluator. Unlike traditional mediation, in which the mediator facilitates discussion without offering opinions, ENE includes a professional assessment of the case’s potential outcomes if it were to go to trial. This evaluation helps both sides make informed decisions about their positions and can often expedite a fair, efficient resolution.
In ENE, the neutral evaluator—often an experienced attorney or retired judge—reviews key aspects of the case and offers their perspective on its strengths, weaknesses, and likely outcomes. There are two main approaches to ENE:
ENE’s goal is to guide both parties toward a fair settlement by offering an objective opinion that can shed light on the risks and rewards of further litigation.
One of the significant benefits of ENE is the opportunity for open, candid discussions. Settlement discussions during ENE are entirely confidential, meaning they cannot be disclosed to the court or used as evidence later. This creates a safe space for both parties to honestly evaluate their case, share concerns, and make offers without the fear that anything said could impact them later in court. This confidentiality can encourage greater cooperation and transparency, leading to more constructive and effective negotiations.
At Johnson/Turner, we support our clients through the ENE process with a skilled, compassionate team ready to help you find a resolution that works for your family. Our team will guide you through every step, ensuring you understand the process and feel confident about your options.
