The Divorce Process in Forest Lake, MN

To file for divorce in Minnesota, you or your spouse must live in the state (or be a military member stationed in the state) for at least 180 days.

As a “no-fault” state, Minnesotans can file for divorce by citing “an irretrievable breakdown of the marriage relationship.” This means it is not necessary to prove that a spouse’s behavior was what led to the divorce.

Once you have reached the state requirements, you can file for divorce. To do so, you must fill out the following forms and file them with the county court. Once you have completed this step, you must serve your spouse divorce papers (you yourself cannot do this, but a law enforcement professional can). There are two types of divorce available in Minnesota:

Uncontested Dissolution of Marriage:

This type of divorce occurs when both spouses, the petitioner and the respondent, agree to all matters regarding child support, visitation, asset division, marital property, alimony etc.

Contested Dissolution of Marriage:

This type of divorce happens when the petitioner and the respondent disagree on one or more issues regarding child support, visitation, asset division, marital property, alimony, etc.

Alternative Dispute Resolution (ADR)

Minnesota courts recognize alternative dispute resolution (ADR) as an effective method to assist couples going through a divorce. During ADR, a mediator will help the couple come to an amicable and fair agreement. The goal is to lessen conflict to avoid taking the case to court. In Minnesota, ADR can include either:

Arbitration:

During arbitration, a neutral third party will listen to both spouses and come to an agreement after. This process may still result in a trial.

Mediation:

During mediation, a neutral third party or mediator, will work with the couple to help them resolve their issues. However, it is up the couple to reach an agreement together.
